When a public land becomes suitable for disposal, it is called Free Patent. Those Agricultural public lands that falls under alienable can be disposed under Free Patent mode.
Qualification:
- Applicant must be born in the Philippines
- Applicant must not own a 12 hectares land or more
- Applicant must have occupied/cultivated the land for not less than 30 years and real estate tax are paid diligently.
- For minors trying to acquire the land through Free Patent, they must be occupying the land and should be presented by their natural parents.
Steps for the approval of Free Patent mode:
- File the application
- Investigation
- A notice is posted in the Barangay Hall, Provincial Capitol or Municipal building for two succeeding weeks
- Applicant must then obtain the Order of Approval of Application as well as the Issuance of Patent
- The Patent will then be prepared in the Judicial Form 54 and 54-D. The form must also obtain a transcribed technical description duly at the back portion.
- The Free Patent shall then be transmitted to the Register of Deeds for the issuing of Original Certificate of Title.
- DENR officials will then approve homestead and free patents applications for these qualifications;
- 5 hectares and below – applicants should go to the officer of Provincial Environment and Natural Resources.
- 5 to 10 hectares – applicants should proceed to the Regional Executive Director of DENR.
