Two Filipina in Hong Kong With Resident Children Fails To Stop Deportation

Two Filipina domestic helpers failed the deportation case which was filed against them. It is said that the two gave birth in Hong Kong and overstayed in the country.

The defendant identified only as GDC and RMA, sought to review their case so they can be with their children who are already residents in Hong Kong.

However, High Court judge Thomas Au dismissed their pleas stating that the applicants have failed in all possible grounds to seek a judicial review.

“In relation to the RMA judicial review, I would also set aside the ex parte leave on the basis of material non-disclosure,” says the judge.

Both cases of RMA and GDC were taken jointly as both have the same situation – they are both mothers who stayed in Hong Kong.

According to reports, RMA first went to Hong Kong in the year 1998. She worked as a domestic helper but her employer terminated her contract on June 28, 2002. By that time, she got pregnant to a baby whose father is a Filipino Hong Kong resident. RMA gave birth to SC on Jul 22, 2003 and the baby became a Hong Kong resident.

But in 2006, they were left by the father of her child. He went home to the Philippines and got married there in the year 2006. After years of becoming an illegal migrant, RMA decided to surrender to the Immigration in April 2007. RMA and SC were both allowed for bail that time.

However, instead of going home, RMA stayed and got married to a Nigerian and gave birth to a baby girl in 2011 and a son in year 2012.

Similarly, GDC went to Hong Kong in 1999 and worked as a domestic helper. In September 2010, she was terminated by her employer. She was pregnant by then.

She applied for a visitor visa extension for grounds of being pregnant and needs to visit a doctor every month. She was granted to stay in Hong Kong until Oct 2010 but she still chose to overstay.

GDC gave birth to JDS on January 2011 and her child became a resident in Hong Kong. As she tried to apply for visa extension, it was found that she overstayed for more than a year. Her reason of not going home is that, her husband in the Philippines and parents never knew that she got pregnant.

According to the judge, the costs will be taxed if both parties will fail to reach an agreement.
